The key to a successful personal injury case
is proving negligence or liability by the person
or entity that has caused the personal injury.
This may not be as easy as it sounds and requires

to prove their case.

When an accident occurs due to the negligence
of another party, the injured party can file a
claim against that party to recover all damages
incurred.
Under the strict liability clause, plaintiffs
can bring a claim against a company whose defective
product has caused a personal injury. These cases
can be applied whether negligence or malice was
or was not involved, as long as the product was
used in the manner and fashion it was intended.
Under intentional wrong, cases can be brought
as a civil suit, personal injury claim or criminal
charges or a combination of the three. In these
cases, the defendant has purposefully inflicted
injury to the plaintiff and this is what needs
to be proven in a court of law. |
